Terms of Service

You should read these terms and conditions in full because they apply every time you visit Kafi, and is our terms of service that governs our relationship with users and others who interact with Kafi, as well as Kafi brands, products and services, which we call the "Kafi Services" or "Services". By using or accessing the Kafi Services, you agree to this Terms. However, just in case you ever need a reminder of the main points, here’s a quick basic Terms:

• You will not use Kafi Services if you are under 9.

• We’re not responsible for anything that you post or say while you are on Kafi and we don’t monitor the content of the app, but if we do see or someone alerts us that you have posted something that we think is inappropriate then we are allowed at our discretion to remove it.

• If you are concerned about how your data is being used by Kafi then please refer to our Privacy Policy, which explains how we treat your personal data and protect your privacy when you use Kafi. By using Kafi, you agree that we can use such data in accordance with our Privacy Policy.

• You will not use Kafi to do anything unlawful, misleading, malicious, or discriminatory.

1. Sharing Your Content and Information

You understand and agree that our Services may review and delete any content, comment, photo, profile (collectively, "Content") that is in the sole judgment of us.

You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Service or any material or information that you transmit to other Members.

By posting any Content to the public areas of the mobile application, you hereby grant us the non-exclusive, fully paid, worldwide license to use, reproduce, publicly perform and display such Content on the mobile application and website, including without limitation distributing part or all of the mobile application and website in any media formats and through any media channels. You represent and warrant that: (i) you own the Content posted by you on the mobile application and website or otherwise have the right to grant the license set forth in this section, and (ii) your Content does not violate the privacy rights, publicity rights, copyright rights, or other intellectual property rights of any person. You agree to pay all royalties and fees owing to any person by reason of any Content you post on the mobile application and website.

The following is a partial list of the kind of Content that is illegal or prohibited on the mobile application and website. We reserve the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators.

Prohibited Content includes Content that:

• Patently offensive and promotes racism, sexism, bigotry, hatred or physical harm of any kind against any group or individual, any content that is obscene, pornographic or otherwise may offend human dignity.

• Harasses or advocates harassment of another person or contains language which could be deemed offensive or is likely to harass, upset, embarrass, alarm or annoy any other person.

• Involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming" or pyramid scams.

• Promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous.

• Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files.

• Contains restricted or password-only access pages or hidden pages or images (those not linked to or from another accessible page).

• Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, providing or creating computer viruses.

• Solicits passwords or personal identifying information for commercial or unlawful purposes from other users; or

• Involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes.

You must use the Service in a manner consistent with any and all applicable laws and regulations.

You may not include in your publicly accessible member profile any telephone numbers, street addresses, last names, URLs, usernames from any social platforms or email addresses.

You may not engage in advertising to or solicitation of, any Member to buy or sell any products or services through the Service. You may not transmit any chain letters or junk email to other Members. Although we cannot monitor the conduct of its Members off the mobile application and website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, we reserve the right to restrict the number of messages which a Member may send to other Members in any period to a number which we deem appropriate in its sole discretion.

You may not attempt to impersonate another user or a person.

2. Protecting Other People's Rights

We respect other people's rights and do our best to keep Kafi safe, and expect you to do the same.

• You will not post content or take any action on Kafi that infringes or violates someone else's rights or otherwise violates the law.

• We can remove any content or information you post on Kafi if we believe that it violates this Terms or our policies.

• If we remove your content for infringing someone else’s copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.

• If you repeatedly infringe other people’s intellectual property rights, we will disable your account when appropriate.

• You will not use our copyrights or Trademarks or any confusingly similar marks, except as expressly permitted with our prior written permission.

• If you collect information from users, you will: obtain their consent, make it clear you (and not Kafi) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.

• You will not post anyone's identification documents or sensitive financial information on Kafi.

• You will not tag users or send email invitations to non-users without their consent.

3. Registration and Account

Kafi users required nick name, age, gender, avatar and other optional information, and we need your help to keep it that way. We provide three ways to access Kafi, email, Google and Apple ID. Here are some commitments you make to us relating to registering and maintaining the security of your account:

• You will not use Kafi if you are under 9.

• You will not transfer your account to anyone without first getting our written permission.

• You will not provide any false personal information on Kafi, or create an account for anyone other than yourself without permission.

• If we disable your account, you will not post any content on Kafi except contact with official assistant which we called "Kafi Team".

• We reserve the right to destroy or ban your account if we believe it is appropriate.

4. Termination

If you violate the Terms, or otherwise create risk or possible legal exposure for us, then we reserve the right at our sole discretion, at any time and without liability or the need to give you prior notice or to refund any unused services to:

• Suspend or revoke your registration (where applicable) and your right to access and/or use Kafi or submit any Content to Kafi; and

• Make use of any operational, technological, legal, or other means available to enforce the Terms (including without limitation blocking specific IP addresses).

We will try (but we are not obliged) to notify you if your access to Kafi and/or your Profile is to be or has been suspended or terminated.

If you have registered on Kafi, you can terminate your registration at any time by going to the "Settings" control on Kafi when you are logged in and choosing the "Delete Account".

5. In App Purchase and Subscription

In App Purchases. From time to time, Kafi may offer additional products and services for purchase through the App Store, Google Play or other application platforms ("in app purchases"). If you choose to make an in app purchase, you will be prompted to enter details for your account with the mobile platform you are using (e.g., Apple, Android, etc.) ("your IAP Account"), and your IAP Account will be charged for the in app purchase in accordance with the terms disclosed to you at the time of purchase as well as the general terms for in app purchases that apply to your IAP Account. If you purchase an auto-recurring periodic subscription through an in app purchase, your IAP Account will be billed continuously for the subscription until you cancel in accordance with the platform terms. In call cases, please refer to the terms of your application platform which apply to your in app purchases.

Subscription Tips:

• Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period;

• Account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal;

• Subscriptions can be managed by the user: auto-renewal can be turned off by going to the user‘s Account Settings after purchase;

• No cancellation of the current subscription is allowed during active subscription period.

6. Disclaimers

We are not responsible for any incorrect or inaccurate Content posted on the mobile application and website or in connection with the Service provided, whether caused by users of the mobile application and website, Members or by any of the equipment or programming associated with or utilized in the Service.

We are not responsible for the conduct, whether online or offline, of any user of the mobile application and website or Member of the Service. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any user or Member communication.

Our Services is not responsible for any problems or technical malfunction of any computer online systems, wireless phones or other devices, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at any mobile application and website or combination thereof, including any injury or damage to users and/or Members or to any person's computer related to or resulting from participation or downloading materials in connection with the mobile application and website and/or in connection with the Service.

Under no circumstances shall Service be responsible for any loss or damage, including personal injury or death, resulting from the use of the mobile application and website or the Service or from any Content posted on the mobile application and website or transmitted to Members, or any interactions between users of the mobile application and website, whether online or offline.

The mobile application and website and the Service are provided "AS-IS" and Service expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Service cannot guarantee and does not promise any specific results from use of the mobile application and website and/or the Service. We take no responsibility for third-party advertisements which are posted on this Service’s mobile application and website or through the Service, nor does it take any responsibility for the goods or services provided by its advertisers.

7. Disclaimer of Warranties

You use Kafi at your sole risk. We do not guarantee that our Services will always be safe, secure or error-free or that our Services will always function without disruptions, delays or imperfections. We make no warranty that our Services will meet your requirements, or Kafi will be uninterrupted, timely, secure and error-free. We make no warranty that the results obtained from us will be accurate or reliable. We make no warranty that the quality of products, Services, information, material or purchased features obtained through our Services will meet your expectations. Any downloaded or obtained material through our Services is done at your own risk.

You will be solely responsible for any damage to your or others’devices directly or indirectly from the download of any such material. Some jurisdiction does not allow the exclusion of such warranties or the limitation or the exclusion of liability for incidental or consequential damages. Some of the limitations of the warranty may not apply to you. In such cases, the warranties and liability will be limited to the fullest extent permitted by applicable law.

8. Limitation of Liability

In no event shall our Services be liable to you or any third-party for any indirect, consequential, exemplary, incidental, special or punitive damages including lost profit damages arising from your use of the mobile application and website or the Service even if our Services have been advised of the possibility of such damages.

Services’ liability to you for any cause, whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the Service during the term of Membership.
